(1) The government of Nepal shall establish a tariff determination commission for determining electricity tariffs and other charges.
(2) In the commission according to sub-section (1), there will be at least five persons from among the representatives of the Government of Nepal, economists, producers, transmission and distributors of electricity and customers.
(3) The commission under sub-section (1) shall determine the electricity tariff and other charges on the basis of depreciation rate, appropriate profit, operating method of the structure, change of consumer price list, royalty etc.
(4) The person who has received the license shall not be allowed to collect any other fees or charges in excess of or in addition to the electricity charges and other charges determined in accordance with sub-section (3).
(5) The commission under sub-section (1) may ask for necessary information and documents from the relevant company, person, agency or organization for the completion of its work, and it shall be their duty to provide them.
(6) While determining the electricity tariff and other charges as per sub-section (1), the commission as per sub-section (1) may determine the tariff according to the type and type of customers.
(7) The procedure of the commission constituted under sub-section (1) shall be as prescribed.
